Record Suspensions can be completed by individuals without the assistance of a lawyer or a third-party company. If it has been five (5) years (summary offence) or ten (10) years (indictable offence), since you completed your last sentence and all fines, surcharges, costs, restitution and compensation orders have been paid, you may apply to the Parole Board of Canada for a Record Suspension.
Record Suspension Application Booklets may be downloaded from the Parole Board of Canada website at http://pbc-clcc.gc.ca/prdons/servic-eng.shtml. This booklet outlines the steps to follow and contains instructions on each of the steps.
The first step in the process is to obtain a copy of your Criminal Record from the RCMP in Ottawa by the submission of your fingerprints. Individuals in the Region of Halton requiring fingerprinting for a Record Suspension may attend the Police Headquarters located at 1151 Bronte Road, Oakville or 12 Division 490 Childs Drive, Milton. When your fingerprints are received back from the RCMP, the Local Police Records Check in the Record Suspension Application Booklet must be taken to every police agency where the applicant has lived in the past 5 years. In Halton, the Local Police Records Check form with two pieces of valid government issued identification must be brought to Halton Regional Police Service located at 1151 Bronte Road, Oakville, Ontario, L6M 3L1 between the hours of 8:00am-3:30pm Monday thru Friday, or dropped off at one of our Districts (see "About Us" for locations and hours).
The fee for the Local Police Records Check is $25.
If an applicant no longer lives in the Halton area and cannot attend in person, they mail the Local Police Records Check form to the Halton Regional Police Service at 1151 Bronte Road, Oakville, Ontario, L6M 3L1.
A clear photocopy of two of the above pieces of identification and the $25.00 fee must accompany the form, and photocopies of the identification must be notarized. The fee may be paid with a personal or certified cheque or a postal or money order. If the fee is paid with a personal cheque, the form will be held for ten (10) business days until the cheque clears the bank.
You do not need a lawyer or representative to apply for a Record Suspension. This will not accelerate the review of your applications or convey a special status on it. The Parole Board of Canada treats all applications in the same way.
You can apply for a Record Suspension by following the step-by-step instructions in the Record Suspension Application Booklet and submitting your completed application forms to the Parole Board of Canada along with the $631 processing fee made payable to the Receiver General for Canada.
