Applicants With a Criminal Record

As an employer, you now have the results of the applicant's police check in hand and that individual has a record.

What do you do?

The existence of a record in itself should not necessarily disqualify an applicant from obtaining a paid or volunteer position with your organization.

Among many things, the Ontario Human Rights Code stipulates that you cannot discriminate against someone based on the existence of a criminal record.

If you deny someone the opportunity to work with you based solely on information relating to a record, you may be required to defend your decision.

The fact that a person has a record for a minor offence, should not necessarily exclude them from a position with your organization.
